摘  要:从劳动分工和资源配置的视角看,人类的司法体系可以分为外行审判司法体系、专家审判司法体系、智能人工司法体系和人工智能司法体系等四种类型。目前信息科技、大数据与人工智能等高科技等被广泛应用于法院改革和建设,促成了各国法院司法体系从专家审判司法体系向智能人工司法体系的"大转型"趋势。中国的"智慧法院"建设虽然处在世界领先地位,但同时也出现了审判业务与信息化建设的"两张皮"现象。本文建议建构一种"大审判管理格局",有效释放"技术红利",把法官从非审判性事务中解放出来,更加专注于规则适用等核心审判工作,并与传统的"以人为中心"的司法改革和当下的"以科技为中心"的智慧法院建设一起,成为中国法院建设的"一体两翼",以实现法院内部资源的最优配置,最大程度地同时实现司法公正和司法效率。From the perspective of labor division and resource allocation, judicial systems in human history can be categorized into layman judge system, expert judge system, smart judge system, and artificial intelligence judicial system. At present, information technology, big data, artificial intelligence, and other high technologies are widely used in the reform and construction of courts, which leads to the "great transformation" of the judicial system of courts in various countries from the expert judge system to the smart judge system. China is leading in this great transformation of courts with its aggressive agenda in developing "smart courts" or "high-tech courts" in recent years. However, China’s courts are still facing a great challenge that the wide adoption of high technology in judicial process might have brought about less judicial efficiency and more costs than expected. For this reason, it is meaningful for courts to improve their trail administration functions through internal reorganization in order to acquire more technological benefits in improving judicial efficiency and justice.
