行政复议中“协调结案”的中国式图景——基于1132件行政复议案件的分析

摘　　要："协调结案"是行政复议中广泛存在的一种现象,呈现出类型相对集中、程序随意性强、方式灵活多样、制约因素多元等特征。"协调结案"之所以大行其道,是由于其可以实现行政复议决定无法实现的"多赢"办案效果。具体而言源于:复议机关基于多重因素的综合考虑、被申请人基于压力驱动的无奈选择、申请人基于利益诉求的理性权衡。但无原则、逾底线、超范围的"协调结案",突破法律优越原则、损害社会公共利益、削弱依法行政意识、消解行政复议监督纠错功能。为发挥"协调结案"的积极功能,可通过明确适用范围、完善运行程序、跟进后续监督等措施规范"协调结案"。"Coordinating settlement of cases"is a widespread phenomenon in administrative reconsideration,which presents the characteristics of relatively concentrated types,strong arbitrariness of procedures,flexible and diverse modes,and multiple constraints.The reason for the popularity of "Coordinating settlement of cases"is that it can achieve the "multi-win"effect that administrative reconsideration decision can not achieve.Specifically,it comes from the following factors:administrative reconsideration organs based on comprehensive consideration of multiple factors,the respondent’s choice based on pressure drive,and the applicant’s rational balance based on interests.However,unprincipled,over the bottom line and Beyond the scope of "Coordinating settlement of cases",breaks through the principle of law superiority,damages social and public interests,weaken the sense of administration by law and eliminate the supervisory and corrective function of administrative reconsideration.In order to exert the positive function of "Coordinating settlement of cases",measures such as defining the scope of application,improving operation procedures and following up the subsequent supervision can be taken to standardize "Coordinating settlement of cases".
