摘　　要：在机构改革的大背景下,推进档案机构改革是一种应有之义。档案机构改革并没有突破体制框架,但要从机构改革的制度逻辑、价值逻辑和目标逻辑的起点上,认识面临的理论困境问题;要走出行政法体系视角,分析档案机构改革的法律调控不足问题;要完善《档案法》及相关档案法律法规体系,解决改革后档案机构行为规范的法律供给不充分问题、档案行政关系顺畅的问题,认识政事分开后的档案局馆新型关系。同时,也需要从先运行而完善的推进路径,看待档案机构改革的理性选择。Undoubtedly,it is necessary to promote the reform of archival organizations under the background of the reform of CPC and state institutions.this action is not meaning to break the framework of archival administrative system,but it should recognize the theoretical dilemma from the starting point of the institutional logic,value logic and objective logic of the reform.We should go out of the perspective of administrative law system and analyze the problem of insufficient legal regulation in the reform of archival organizations.It is necessary to perfect the archives law and related archival regulations for solving the problems of insufficient legal supply of the code of conduct of archival organizations after the reform and smooth archives administrative relations,and understanding the new relationship between archival bureaus and archives after the separation of administration and affairs.At the same time,it is necessary to look at the rational choice of the reform of archival organizations from the perspective of promotion path meaning operation firstly and perfect later.
