摘 要:养老服务业的快速发展,对政府转变职能、创新监管提出了挑战。本文基于养老服务业开展"放管服"改革这一背景,从社会性规制的过程和内容两个维度,探讨我国20世纪90年代以来养老服务业政府规制的发展转变,聚焦建立新型政府规制这一核心问题,围绕养老服务业新型政府规制的两个面向及其形成的四个突破进行分析,并从养老服务质量的"结果"规制、负面清单式管理方式和"规制沙盒"提出养老服务业政府规制的三个发展方向。The rapid development of China’s elderly service industry has put forward new challenges to the transformation of government’s functions and innovation supervision.Against the backdrop of The Reform of Streamlining Administration,Delegating Power,Improving Regulation and Optimizing Services in elderly service industry,this paper explores the development and changes of government regulation of elderly service industry since the 1990 s from two dimensions of the process and the content of social regulation.As a purpose,this paper establishes a core issue of new government regulation.The following analysis refers to two aspects and four breakthroughs of the new government regulation in elderly service industry.Moreover,this paper proposes three reform directions of the elderly service industry,which are the results regulation of elderly service quality,the management method of negative list and the regulation sandbox.
