摘 要:人道主义干涉这一概念自从被提出以来就一直受到国际社会的广泛讨论,由于人道主义干涉是建立于主权国家内部人道主义危机之上,那么实施人道主义干涉必然会涉及到主权以及人权的优先级问题,由此便引出了针对人道主义干涉的合法性讨论。国际社会是人道主义干涉的依托,同时国际社会有自己的规则,参与其中的看似是主权国家,其实是遵守每个国家内在规则的领导者。这样就引出了主权国家是否进行人道主义干涉时面临自身国内规则的合法性以及国际社会框架内的国际合法性的讨论。同时,我们应该在进行人道主义干涉之前对人道主义灾难进行判别,该灾难是否达到采取人道主义干涉的级别。The concept of humanitarian intervention has been widely discussed by the international community since its inception.Since humanitarian intervention is based on humanitarian crises within Sovereign States,the implementation of humanitarian intervention inevitably involves the priority of sovereignty and human rights,thus leading to discussions on the legality of humanitarian intervention.The international community is the basis for humanitarian intervention,and at the same time the international community has its own rules.Countries that participating in appears to be Sovereign States,but in fact it is the leaders who abide by the inherent rules of each country.This leads to the discussion of the legitimacy of the domestic rules and the international legitimacy within the framework of the international community when sovereign states engage in humanitarian intervention.At the same time,we should judge a humanitarian disaster before it is carried out,whether it reaches the level of humanitarian intervention.
