“以审判为中心”背景下公安改革有关问题探究——以山西省公安机关执法创新为视角

摘　　要：“以审判为中心”的诉讼制度要求公安机关改变“以侦查为中心”的理念,加快侦查模式转变、提高证据证明能力、履行警察出庭作证义务和培养高素质执法主体。山西公安根据本省现状,在推动大数据平台办案、设置统一证据标准、规范警察出庭作证、推动辅警问题地方立法等方面进行了积极探索,取得一定成绩,但仍存在大数据平台使用不规范、涉案财物保管不严、程序违规问题突出和警察出庭作证能力不足等情况,需进一步改进和完善。The“trial-centered”litigation system requires the police to change the concept of“investigation-centered”,speed up the transformation of investigation mode,improve the ability of evidence proof,fulfill the obligation of police to testify in court and cultivate high-quality law enforcement subjects.According to the current situation in Shanxi Province,Shanxi police has actively explored the police working such as promoting big data platforms to handle cases,setting uniform standards of evidence,regulating police testimony in court,and promoting local legislation on auxiliary police issues,and has achieved certain results.However,there are still some problems,such as irregular use of big data platforms,inadequate custody of property involved in the case,prominent procedural violations,and inadequate police testimony capabilities,which need to be further optimized and improved.
