人工生育子女亲子关系问题研究

摘　　要：随着晚婚晚育以及不孕不育人群的增多,利用人类辅助生殖技术孕育子女亦随之增多。当前我国法律对人工生育子女亲子关系方面的认定尚不完善,这一现状不利于人工生育子女相关权益的保障及家庭社会的和谐。除引言与结语外,共有四个部分。第一部分对人工生育子女亲子关系进行了简单概述。首先就人工生育子女的类型作了简要陈述,然后总结了我国目前为止在人工生育子女亲子关系方面的法律规范现状,最后陈述了在人工生育子女亲子关系不明确的情况下所潜藏的隐患。第二部分介绍了国外在人工生育子女亲子关系方面的立法成果。第三部分从两个典型案例入手,结合我国司法实务,对人工生育子女亲子关系进行了进一步阐释。第四部分结合我国实际,吸收国外经验,提出了对于我国人工生育子女亲子关系方面的一些建议。With the increase of late marriage,late childbearing and infertility population,the use of human assisted reproductive technology to breed children is inevitably increasing.Nowadays,the recognition of the parentchild relationship of artificial child-bearing in Chinese law is not perfect,which is not conducive to the protection of the rights and interests of artificial child-bearing and the harmony of family and society.In addition to the introduction and conclusion,this paper had four parts.The first part gave a brief overview of the parent-child relationship of artificially born children.This paper first gave a brief statement on the types of artificial child-bearing,then summarized the current situation of legal norms on the parent-child relationship of artificial child-bearing at present in China,and finally stated the hidden dangers under the circumstance of unclear parent-child relationship of artificial child-bearing at present.The second part introduced the legislative achievements of foreign countries in the field of parent-child relationship of artificially born children.The third part started with two typical cases and further explained the parent-child relationship of artificially born children in the light of China’s judicial practice.The fourth part combined the reality of our country and absorbed the experience of foreign countries.The author put forward some suggestions on the parent-child relationship of artificial child-bearing in our country.
