大学内部治理中的学生参与：动因、路径及其实现

摘　　要：学生参与大学治理不仅符合国家法律法规的要求,也体现高校对学生主体性地位的重视。但是当前大学民主管理中学生参与程度低,大学内部治理权利的失衡与僭越漠视了学生参与的主体性。大学生作为学校活动的主要参与者,其角色不应仅是被动的参与者,更应是主动的治理者。从学理的逻辑上看,必须至少从国家要求、高校需求及学生自身诉求三个层面,以程序性权利和实体性权利的分类为依据,从学生参与大学治理的一般参与和深度参与两条路径分析,通过公开高校管理信息、畅通高校信息沟通机制,提高一般参与高校管理活动中学生参与监督的程度;通过建立执行活动中的大学生参与制度、高校内部的听证程序等路径,真正保障学生在深度参与高校管理活动中的权利,实现学生参与大学治理。Student participation in university governance not only meets the requirements of national laws and regulations,but also reflects the importance of student subjectivity in universities.However,at present,the participation of students in the democratic management of universities is low,and the imbalance and arrogation of the internal governance of universities ignore the subjectivity of student participation.College students,as the main participants in school activities,should not only be passive participants,but also active administrators.We must at least view from the three levels of national requirements,university needs and students’own demands,based on the classification of procedural rights and substantive rights,analyze the two paths of students’general participation and deep participation in university governance.Through opening the management information and unblocking the information communication mechanism of universities,we can improve the degree of student participation in the supervision of the general management activities of universities.Through the establishment of the participation system of university students in the implementation activities and the internal hearing procedures of universities,the rights of students in the deep participation in the management activities can be truly guaranteed,and the participation of students in the governance of universities can be realized.
