体育彩票发行与销售管理的行政法反思

摘　　要：我国体育彩票发行与销售管理制度以国家特许、政府经营和多部门共同监管为特征。该制度在排除社会竞争、防止欺诈的同时,也带来了经营与监管合一的现象,导致体育彩票发行销售机构腐败、彩票公信力下降。为此,立法者和其他规制者正在启动新一轮彩票立法与改革。我国过去倚赖行政规制,体育彩票国家发行和政府经营的规范基础薄弱,在此背景下进行改革,需要在立法过程中作大量精细化处理,确保发行与销售管理和行政规制体系相协调,并在国家治理现代化中寻求出路。The system of lottery issuance and sales management in China was characterized by state-chartered issuance, government operation and multi-sectoral supervision. While eliminating social competition and preventing fraud in lottery issuance, the system brought the integration of operation and supervision, which led to corruption of lottery issuing and selling institutions and decline of lottery credibility. To this end, legislators and other regulators launched lottery reform. In the past, China relied heavily on administrative regulation and the foundation of its regulation was weak. Under this background, lottery reform needed a lot of elaborate arrangements in the legislative process to ensure the coordination of the lottery issuance and sales management system with the administrative regulation system and looked for a way out of this reform during the modernization national governance.
