矿难行政问责中惩戒机制的运行逻辑研究

摘　　要：从反向运动理论的视角设计了矿难行政问责中惩戒机制的分析框架,借助官网2012-2018年较大矿难事故的追责数据,检验了惩戒机制运行的逻辑。研究发现,在惩戒机制运行中“问责事由”与“职务层次”发挥关键作用,对惩戒力度的影响总效果值最大;“问责事由”是“经济损失”“职务层次”影响“惩戒力度”的中介变量;“经济损失”和“服从程度”发挥的作用很小,“媒体报道”不发挥作用;正式规则与非正式规则并存于惩戒机制中,正式规则发挥的作用大于非正式规则;惩戒机制运行的结果具有不稳定性。以上说明,若通过惩戒机制增强反向运动效果,需要依赖政府积极做出制度安排,降低职务层次影响力,优先法制逻辑,让正式规则发挥更大的作用。From the perspective of counteractive movement theory,this paper designs the analytical framework of the punishment mechanism in the administrative accountability of mining accidents,and tests the logic of the punishment mechanism by means of the accountability data of major mining accidents on the official website from 2012 to 2018.The study finds that in the operation of the punishment mechanism(1)“causes of accountability”and“position level”play a key role,and their total effect value to the punishment intensity is the largest.(2)“Cause of accountability”is the intervening variable between“economic loss”“position level”and“punishment strength”.(3)“Economic loss”and“degree of obedience”plays a small role,and“media coverage”dose not.(4)there are two rules,formal rules and informal rules,coexist in the disciplinary mechanism,and the former plays a greater role.(5)The outcome of the punishment mechanism is unstable.So,if the performance of the counteractive movement wants to be enhanced through the punishment mechanism,it relies on the government to actively make institutional arrangements,to reduce the influence of the position level,to use legal logic first,and to make formal rules play a greater role.
