摘 要:城镇化的发展极大地影响了集体土地所有权制度,带来了集体土地所有权制度主体、权能内容、行使方式、实现目的等多方面的变化。为因应这一变化,应当在现阶段实行集体成员不因其进城落户而丧失集体成员资格和进城落户集体成员自愿有偿退出承包地、宅基地的政策,但从最终实现进城落户集体成员的城镇化考虑,也应适时建立市民化集体成员资格的强制退出机制;应当建立以户为单位的农民集体成员权行使机制及其委托代理机制;应当正确处理土地三项改革中村组集体土地所有权关系;应当在农民集体所有权的行使中将管理权能的行使转向经营管理为主。With the development of urbanization, the system of collective land ownership has been greatly affected, bringing about changes in the subject, power content, exercise mode and realization purpose of collective land ownership system. In order to cope with this change, it is necessary to implement the policy of collective members not losing their collective membership due to their entering the city and settling down in the city, and the collective members voluntarily withdrawing from the contracted land and homestead with compensation, but from the consideration of realizing the urbanization of the collective members entering the city and settling down in the city, it is also necessary to establish the compulsory withdrawal mechanism of the citizenized collective membership in time;a mechanism for the exercise of farmer collective membership rights and its principal-agent mechanism should be established at the household level;the relationship of collective land ownership of the village group in the three land reforms should be properly handled;In the exercise of the collective ownership of farmers, the exercise of management power should be shifted to operation and management.
