摘　　要：法制理念是法制建设的灵魂、精神实质和价值追求,社会主要矛盾对法制理念变迁起决定性作用。新中国成立以来,随着国家发展思想和立法思维的变化,水工程移民法制理念从补偿性移民到开发性移民再到“以人为本”移民,几经变迁。新时代下,社会主要矛盾转化、新发展思想提出和宪法修改,在给水工程移民法制理念带来巨大冲击的同时,也为水工程移民法制建设指明了方向。对此,应依据水工程移民法制理念变迁规律,实现水工程移民法制理念向“以人民为中心”的转变。在此基础上,依据法律保留原则将水工程移民中私有财产征收、征用等法律保留事项纳入法律规制范畴,重构水工程移民法制体系,实现移民权利与公权力之间的平衡。The concept of legal system is the soul,spiritual essence and value pursuit of legal system construction and the social principal contradiction plays a decisive role in the change of legal concept.Since the founding of New China and with the change of national development thinking and legislative thinking,the legal concept of water project resettlement has changed from compensatory resettlement to development resettlement and then to“people-oriented”resettlement.In the new era,the transformation of social principal contradictions,the proposal of new development ideas and the revision of the Constitution have not only brought a great impact on the legal concept of water project resettlement,but also pointed out the direction for the legal construction of water project resettlement.In this regard,according to the changing law of the legal concept of water project resettlement,China should realize the transformation of the legal concept of water project resettlement to“people-centered”.On this basis and according to the principle of legal reservation,the legal reservation matters such as expropriation and requisition of private property in water project resettlement should be brought into the scope of legal regulation,and the legal system of water project resettlement should be reconstructed to realize the balance between resettlement rights and public power.
