公安执法规范化视阈下侦查讯问权利告知程序的思考

摘　　要：中央全面深化改革领导小组第二十四次会议审议通过了《关于全面深化公安执法规范化建设的意见》,为新形势下健全公安执法体制机制明确了改革要点和基本方向。全面深化执法规范化建设的核心是刑事执法规范化,完善执法制度机制,为公安机关提供健全、完备的执法指引。在刑事诉讼程序中,为实现控辩平等对抗,应确保犯罪嫌疑人对诉讼权利的知悉权。权利告知程序是公安机关采取讯问等侦查措施的前置程序,笔者特择取其为研究对象,对域外侦查讯问中权利告知规则进行考察,尝试从明确权利告知的具体内容和完善监督执法等方面提出推行公安刑事执法规范化改革的对策。The Twenty-fourth Meeting of the Central Leading Group for Comprehensive Deepening Reform reviewed and approved the Opinions on Comprehensively Deepening the Construction of Standardization of Public Security Law Enforcement(hereinafter referred to as the“Opinions”),which clarified the reform points and basic directions for improving the public security law enforcement system and mechanism in the new situation.The core of comprehensively deepening the standardization of law enforcement is the standardization of criminal law enforcement,the improvement of the law enforcement system and mechanisms,and the provision of sound and complete law enforcement guidance to public security organs.In the criminal procedure,in order to achieve equal confrontation between the prosecution and the defense,the right of the criminal suspect to be aware of the litigation rights should be ensured.The procedure of notification of rights is a pre-procedure for public security organs to take investigation measures,such as interrogation.The author chose to take it as a research object,examined the rules of notification of rights in extraterritorial investigations and attempted to propose countermeasures to promote standardized reform of criminal law enforcement by clarifying the specific content of the notification of rights and improving supervision and law enforcement.
