张家山汉简《二年律令》土地制度立法意图及相关途径探析

摘　　要：土地制度乃立国之本,汉代草创之初,在人民离散、土地凋敝、北方匈奴环伺的恶劣形势下,统治者通过先进的法律,迅速收拢流民,分配土地,短时间内创建了国家富强、社会稳定、人民安居乐业的良好局面。张家山汉简《二年律令》从原始档案的角度为人们了解、研究这段史实提供了新的法律视角,通过分析农民受田的相关规定和有关土地所有权的法定丧失和意定丧失等情形,可以体察汉初立法者理性、民本、维护公平诚信、维系宗法伦理制度和保障弱势群体的先进立法观念与高超的立法技术。同时,该法令也从实证角度证明了中国古代法律体系中民事法律思维的先进性和成熟性,甚至其中很多立法理念和立法技巧对今天的立法工作仍然能够提供镜鉴。The land system is the foundation of a nation. During the early period with the people′ s separation, land lying waste, andthe northern Hunnu′ s coveting, the Han Dynasty rulers quickly collected the refugees and distributed land, and through advancedlaws, created country with national prosperity, social stability and the people′ s life and work in a good situation in a short period oftime. The Zhangjiashan bamboo slit book Two-Year Law as the original archive provides a new legal perspective for people to un-derstand and study this historical reality. Through the analysis of farmers affected by the relevant provisions of the field and the le-gal and intent loss of land ownership, we can examine the early Han′ s legislators′ rational, people-oriented and advanced legisla-tive concept and superior legislative technology to maintain fairness and integrity and the patriarchal ethics system and to protectthe vulnerable groups. At the same time, the decree also proves the advanced and mature civil legal thinking in the ancient Chineselegal system from an empirical point of view, and even many of the legislative ideas and legislative skills can still provide a mirrorfor today′ s legislative work.
