涉疫情刑事案件争议问题的分析与认定

摘　　要：对于故意使医务人员感染新型冠状病毒的行为,不宜一律以故意伤害罪论处;在未引起休克或者因呼吸功能障碍出现窒息征象时,可以考虑能否评价为寻衅滋事行为,符合刑法第293条规定的,以寻衅滋事罪定罪处罚。妨害传染病防治罪的主观方面应为过失;妨害传染病防治罪与过失以危险方法危害公共安全罪存在法条竞合的关系,宜根据“特别法条优于一般法条”的原则认定为妨害传染病防治罪。对于非法经营罪中哄抬价格的认定,要充分考虑市场因素,结合生产供应状况、疫情防控需要、涉案商品真伪优劣、经营人员主观恶性、行为社会危害程度等方面,综合判断价格上涨是否超出合理范围以及涉案行为是否严重扰乱市场秩序。The acts of intentionally causing medical workers to infect coronavirus disease should not be all punished as the crime of willful and malicious injury.It can be considered whether it can be evaluated as an act of provocation,if it conforms to the provisions of Article 293 of the Criminal Law,it should be convicted and punished as the crime of provocation.The subjective aspect of the crime of impeding the prevention and control of infectious diseases should be negligence.The relationship between the crime of impeding the prevention and control o f infectious diseases and the crime of endangering public safety by dangerous means aligns with the similar provisions and should be dealt with as the crime of impeding the prevention and control of infectious diseases according to the principle that"special provisions are superior to general provisions".To determine the act of whooping up prices in the crime of illegal business operation,we should fully consider the market factors,and comprehensively judge whether the price rise is beyond the reasonable scope and whether the act seriously disturbs the market order with reference to the production and supply situation,the needs of epidemic prevention and control,the quality of the goods involved,the subjective malice of the operators,the degree of social harmfulness,etc.
