村级民主决策制度的运行实效与优化路径——基于吕梁市13个行政村的田野调查

摘　　要：村庄常住人口大多为中老年人,文化程度普遍偏低,民主决策能力不足,影响了制度运行实效委;村民代表会议制度运行良好,村民会议制度功能弱化;贯彻落实“四议两公开”制度存在差距与不足。《村组法》关于村民会议的规定过于庞统、模糊,不利于发挥村民会议的积极功能;《村组法》没有规定违反村民(代表)会议相关规定的法律责任;村级民主决策权保障机制缺乏,被侵犯时缺乏有效的救济方式。优化村级民主决策制度应当完善村民(代表)会议会前协商制度,健全村级重要事项、重大问题由村党组织研究讨论机制,建立健全村民民主决策法律保障体系。Most of the permanent residents in the village are middle-aged and elderly people,whose education level is generally low and democratic decision-making ability is insufficient,which affects the effectiveness of the system operation.The function of the village council system is weakened.There are gaps and deficiencies in the implementation of the system of“four discussions and two publicity”.The provisions of the village group law on the villagers meeting are too complex and vague,which is not conducive to the active function of the villagers meeting;the village group law does not stipulate the legal responsibility for violating the relevant provisions of the villagers meetings or representatives meeting;the guarantee mechanism for the village level democratic decision-making right is lacking,and there is no effective relief method when violated.In order to optimize the democratic decision-making system at the village level,it s advisable to improve the consultation system before the villagers(representatives)meeting,to improve the research and discussion mechanism of important matters and major issues at the village level organized by the village party organization,and to establish and improve the legal guarantee system for democratic decision-making of villagers.
