摘　　要：期前违约制度旨在保护债权人履行期到来前的利益,现已被各国合同法和CISG所采纳,但是期前违约"减损原则"的适用仍然存在疑问。期前违约制度基础并非在于债权人与债务人之间的合意而在于违反当事人间因信赖而生的"合同维持"义务,因此所谓债权人是否具有"减损义务"实际取决于"合同义务"的违反与损害之间是否具有因果关系。Mitigation rule aims to protect the interests of creditors before the time of performance and has been widely admitted by contract laws of various countries and CISG. However, there are still some doubts on the application of the mitigation rule in anticipatory breach. The foundation of anticipatory breach is the breach of "contract maintaining" obligation originated from mutual trust rather than the agreement reached between parties. Consequently, the essence of mitigation rule relies on the causality between the obligation violation and damage.
