摘　　要：全国首例"暗刷流量"案的审理,为人们提供司法途径以了解这一产业的运行模式,同时也展现了法律对"暗刷流量"行为的否定评价。这一现象对社会公共秩序的影响恶劣,如不加以遏制,将会助长社会的不正之风,个案的审结仅是价值上的引导,更重要的是针对这一现象法律规则的树立和完善。由此便需要从"暗刷流量"现象的产生与演变、规范刍议和实践指引三个方面展开,明确"暗刷流量"的产生背景与演变路径,通过"暗刷流量"案的审理明确已有的行为规制规范及改进方向,进而通过理论与实践的联系,指明典型案件对立法、行政、司法与守法的实践指引作用。The trial of the first"dark brush flow"case in the country provides people with a judicial way to understand the operation mode of this industry,and also shows the negative evaluation of the law on the"dark brush flow"behavior.This phenomenon has a bad influence on the public order of the society.If it is not contained,it will contribute to the unhealthy trend of the society.The conclusion of the case is only the guidance of value,and more importantly,the establishment and improvement of the legal rules for this phenomenon.Therefore,it is necessary to carry out the three aspects of the generation and evolution of the"dark brush flow"phenomenon,the normative discussion and the practical guidance,and clarify the background and evolution path of the"dark brush flow".Some behavioral regulation norms and improvement directions,through the connection between theory and practice,indicate the practical guiding role of typical cases in legislation,administration,justice and law-abiding.
