法医学鉴定强制性标准的现状、问题和对策——以《强制性国家标准管理办法》为视角

摘　　要：法医学鉴定意见是重要的诉讼证据,鉴定标准尤其是强制性标准直接影响鉴定意见的科学性、公正性和权威性。当前我国法医学鉴定的强制性国家标准仅有3项,推荐性国家标准及行业标准489项。法医学标准数量有限,尤其强制性标准奇缺,已经影响到我国法医学鉴定实践和学科发展。《强制性国家标准管理办法》旨在加强和推进我国强制性国家标准的管理和发展。笔者建议,以该办法的实施为契机,相关行政管理部门应当发挥更多作用,采取有力措施推进法医学鉴定强制性国家标准的制定,进一步补充、修改、完善法医学鉴定行业标准,强化法医学鉴定强制性国家标准的执行。Forensic expert opinions are important litigation evidence, and the Identification standards, especially the mandatory standards, directly affect the scientificity, impartiality and authority of expert opinion. At present, there are only three mandatory national standards and 489 recommended national standards and industry standards for forensic medical appraisal in China, The limited number of forensic medical standards, especially the lack of mandatory standards, has affected the forensic practice and discipline development in China. "Measures for the Administration of Mandatory National Standards" aims to strengthen and promote the administration and development of mandatory national standards in China. The authors suggest that, taking the implementation of this legal document as an opportunity, relevant administrative departments should play a more important role, take effective measures to promote the development of mandatory national standards for forensic identification, further supplement, modify and improve the industry standards for forensic appraisal, and strengthen the implementation of mandatory national standards for forensic appraisal.
