论影视作品角色造型商品化权益的保护

摘  要:影视剧角色造型商品化是角色商品化的一种具体表现形式,包含对角色造型进行二次商业化利用的一系列行为,背后蕴含着巨大的经济利益,由此产生的法益被称为“商品化权益”。我国法院对该项权益进行保护的法律依据多有不同,学界对此也存在广泛争议。就目前而言,我国不宜构建一个独立的“商品化权”制度,而应当在现有法律体系框架内,从反不正当竞争法、著作权法和人格权法等角度,对商品化权益提供必要的保护。具体到角色造型商品化权益这一问题,应对类动画造型提供著作权保护,对人物造型提供交叉保护。The character modeling merchandising in film and TV works,a specific form of character merchandising,includes a series of behaviors of the secondary commercialization of character modeling,and leads to potential economic interests,therefore,the legal rights and interests generated thereby are called“the rights and interests of merchandising”.In judicial practice,Chinese courts depend on different legal bases for its protection,and there are extensive disputes in the academic circle.At present,it is not suitable for China to construct an independent system for“merchandising right”.It is acceptable to provide necessary protection for the rights and interests of the character modeling merchandising according to Law of People’s Republic of China Against Unfair Competition,Copyright Law,Personal Status Law and other laws within the framework of the existing legal system.In terms of the protection of the rights and interests of character modeling merchandising,it is also necessary to provide copyright protection for quasi-animation modeling and cross-protection for character modeling.
