摘　　要：在高校建设发展过程中,高校的章程建设至关重要。法律视角下我国高等学校章程建设存在管理者的法治观念和思想有待提升、章程的法律地位缺乏明确规定、章程对相关法律关系界定模糊、章程的制定与修改规定不完善、章程内容要素缺乏本校特色以及学校对章程的认同感和执行力不足的问题。法律视角下高等学校的章程建设要强化管理者依法治校的思想理念、明确学校章程的法律地位和效力、在章程中明确相关主体的法律关系、重视章程制定与修改规定的完善、章程要重视特色内容的创新建设、提升高校对章程的认同感和执行力。In the process of the construction and development of universities,the constitution building of universities is very important.In the legal perspective,there exist problems in the constitution building of universities in China,such as the managers’idea and thought of rule of law to be improved,the unclear provisions of the legal status of the constitution,the vague definition of the relevant legal relationship in the constitution,the imperfect formulation and modification of the constitution,lack of the characteristics of the university in the content elements of the constitution,and the insufficient recognition and execution of the constitution.In the legal perspective,we should strengthen the ideological concept of the administrators’running school according to law in the constitution building of universities,clarify the legal status and effectiveness of the university’s constitution,make clear the legal relationship of the relevant subjects in the constitution,attach importance to the perfection of the constitution formulation and modification provisions,and to the innovation and construction of the characteristic contents in the constitution,and enhance the recognition and execution of the constitution by universities.
