摘 要:《劳动合同法》第38条以强行性规范的方式规定了用人单位缴纳社会保险的义务,然而在实践中存在用人单位与劳动者约定放弃缴纳社会保险的情形。司法实践和地方性规范文件对此类约定之效力认定存在较大差异,学术界对此也存在较大意见分歧。无论从法社会学角度还是规范法学角度考察,肯定弃权条款的效力都更具有合理性。在处理此类案件时,司法机关可以直接适用诚信原则,在确定当事人意思表示真实的前提下,对弃权条款的效力做出肯定性裁判。Article 38 of Labor Contract Law stipulates the obligation of employing unit to pay social insurance by means of mandatory norms.However,the employing unit and laborer usually agree on waiving the social insurance payment in practice.There are great differences between judicial practice and local normative documents on the validity of such agreements.Moreover,there exist great differences in opinion in academic circles.From the angle of law sociology or normative law,affirming the validity of waiver clause is more reasonable.When dealing with such cases,the judicial organ can directly apply the principle of good faith and make a positive judgment on the validity of waiver clause on the premise of determining the true intention of the parties concerned.
