论党内法规配套立规的政治逻辑及其制度实现

摘　　要：党内法规配套立规,既是贯彻落实党章和中央党内法规的必要措施,也是中央纪律检查委员会、党中央工作机关和地方省级党委党内法规立规工作的重点,具有从属性、实施性、规范性和耦合性。党内法规配套立规在制度设计、实践运行中应当把政治性放在首位,因而必须遵循一定的政治逻辑,应当把贯彻落实民主集中制作为政治原则,把做到“两个维护”作为政治目的,应当把力戒形式主义、官僚主义作为政治要求。为体现配套立规的政治逻辑,落实《制定条例》的目标要求,回应当前配套法规建设存在的突出问题,应当坚持优位原则、授权明确性原则、辅助原则和比例原则,完善相关配套工作体制机制,从而促进党内法规制定的规范化、科学化、精细化,推进配套立规的有效开展。Formulating subordinate inner-Party laws and regulations is not only the necessary measure to implement the Party constitution and the rules and regulations within the Party central committee,but also the focus of the work of the central commission for discipline inspection,the working organs of the Party central committee and the local Party committees at the provincial level.Subordinate inner-Party laws and regulations should give priority to politics in the design and practice of the system,and must therefore follow a certain political logic.It should take the implementation of democratic centralism as the political principle,and the“maintenance of the two”as the political goal.We shall form a complete set of technical principles,improve the related work mechanism,so as to speed up the construction of inner-Party laws and regulations system covering all aspects of the Party leadership and Party building,implement the goals and requirements in the“Enactment Regulation”,solve the insufficiency problem of subordinate inner-Party laws and regulations.Only in this way can we guarantee the normative,scientific and refined formulation of inner-Party laws and regulations,and promote the development of subordinate inner-Party laws and regulations.
