村寨逻辑与纠纷调解——黔东南州剑河县村寨内纠纷调解研究

摘　　要：我国目前社会发展正处于转型期,新旧矛盾交织、传统调解制度陷于困境,但是在一些基层村寨,调解制度却在运行中显示其独有的魅力。尝试克服传统调解研究路径的弊端,遵循社会结构的研究路径,以剑河县村寨内林权纠纷调解为个案,对新时期村寨内运行精良的纠纷化解机制进行法人类学解读,以期为理论和实务界提供可资利用的经验,推动调解制度的大发展。通过对剑河县调解组织制度及调解过程的深入剖析,感受到该县村寨调解在社会结构影响下的独特运行逻辑:基于经济的低水平发展、国家权力的微弱影响和浓郁民族宗族文化的影响,尽管在纠纷解决中嵌入了大量现代化的因子,调解在纠纷解决中的优势地位日趋式微,但它依然是村民在遇到纠纷时的首选和最主要的纠纷解决方式;村寨调解坚持实用主义调解原则,依靠民间权威和制度权威,运用民风、民俗、村规民约、情与理等地方性知识调解矛盾纠纷,促成了调解制度独特的生命力。With the social development of our country in transition period,the old and new contradic tions interweave and the traditional mediation system is in trouble,but in some villages at the grass roots level the operation of the mediation system is in showing its unique function.Taking the village forest rights dispute mediation in Jianhe County as an example and using the method of anthropology,this present paper tried to overcome the disadvantages of research path of traditional mediation and fol low the research path of social structure to interpret the excellent dispute resolving mechanism in the villages in the new period,in order to offer available experience for the field of theory and practice and promote the great development of mediation system.According to the in-depth analysis of the or ganization system and process of mediation of the Jianhe,it was found that the village mediation in the unique operation logic under the influence of the social structures were as follows:based on the low level of economic development,the weak influence of state power and the influence of strong ethnic clan culture,although a large number of modern factors were embedded in the dispute resolution,and the dominant position of mediation in the dispute resolution was declining,it was still the first choice and the most important way for villagers to resolve disputes;village mediation adhered to the pragmat ic mediation principle and relied on folk authority and institutional authority,using local knowledge such as folk custom,folk custom,village rules and regulations,emotion and reason to mediate con flicts and disputes,thus contributing to the unique vitality of the mediation system.
