摘　　要：中国社会转型对婚姻家庭的影响是全面而深刻的。婚姻家庭法制改革需与社会发展同步,回应社会需求。将男女法定婚龄降低至自然人成年年龄,符合完全民事行为能力的本质内涵,有利于实现民法体系内部协调统一,还可消除男女结婚年龄上的不合理区分。在新的人口、社会、经济形势下,实现我国民事法律导向从限制生育向自主生育转型的重要举措之一是从赋权角度调整夫妻共同生育行为。人工生殖技术应用引发亲子关系确认规则变化,当传统规则"失灵"时,确立新的规则成为必要。异质人工生殖情形下的亲子关系认定应综合考虑采取人工生殖技术生育子女的合意、未成年子女最佳利益、事实抚养关系的形成等各种因素。The impact of China’s social transformation on marriage and family is comprehensive and profound.The legal reform of marriage and family should keep pace with social development and respond to social needs.Lowering the legal marriage age of men and women to the"adult age"of natural persons is in line with the essential connotation of full civil capacity,which is conducive to the internal coordination and unification of the civil law system,and can also eliminate the unreasonable distinction in the age of marriage of men and women.Under the new situation of population,society and economy,one of the important measures to realize the transition of China’s civil law from limited birth to self-decision birth is to adjust the birth behavior of husband and wife from the perspective of empowerment.The application of artificial reproductive technology leads to the change of rules of parent-child relationship identification.When the traditional rules"fail",it becomes necessary to establish new rules.The identification of parent-child relationship in the case of heterogeneous artificial reproduction should take into account various factors,such as the agreement of infertile couples to adopt artificial reproduction technology,the best interests of minors,and the formation of the de facto relationship of parental support to children.
