摘 要:在地方性法规创设行政处罚的理论研究中,始终未能对行政处罚设定权条款的地位及其构成给予足够的关注。由于行政处罚法是由全国人民代表大会在立法法颁行前制定的,因而行政处罚设定权条款的法律地位及构成明显异于行政许可、行政强制。这种差别本质上是我国宪法确立的发挥地方"两个积极性"原则的集中体现,实际上也赋予了地方性法规创设行政处罚的更大空间。正确认识和全面把握行政处罚设定权条款的地位和构成,不仅有助于推动行政处罚法的修改和完善,而且对于激发地方立法机关的主动性、积极性,最大限度地释放地方治理的能力与活力,具有重要的意义。In the theoretical study of administrative penalty established by local regulations,the sufficient attention has not been paid to the status and structure of establishment power clause.Since the Administrative Penalty Law was enacted before the Legislative Law by the National People’s Congress,the legal status and structure of establishment power clause in administrative penalty are obviously different from those in administrative license and administrative coercion.Essentially,this difference is a concentrated reflection of the principle to develop the local“Two Initiatives”established by our Constitution.In fact,it also gives local regulations greater space to establish the administrative penalty.It is of great significance to properly understand and comprehensively grasp the status and structure of establishment power clause in administrative penalty,which not only helps to promote the amendment and improvement of the Administrative Penalty Law,but also stimulates the initiative and enthusiasm of local legislatures and furthest releases the ability and vitality of local governance.
