摘 要:修订后的《中华人民共和国政府信息公开条例》以"公开为常态、不公开为例外"为原则,重新塑造了政府信息公开的制度环境。而新条例所塑造的制度环境必将会对政府信息公开诉讼产生重大影响。人民法院应当结合新条例所塑制度环境,对政府信息公开案件的审理、审判理念和裁判思路做出相应调整,尤其对政府信息公开诉讼中的裁判理由、合法性标准、类型化快速审理、行政与司法双重解纷、原告主体资格、法律责任主体认定、受案范围、主动公开、审查对象、审查重点等问题应予以关注。The revised Regulations on Government Information Publicity of People’s Republic of China reshapes the environment of the government information publicity system based on the principle of "publicity is the norm and non publicity is the exception". The institutional environment shaped by the new regulations will definitely have a significant impact on government information publicity litigation.The people’s courts should make corresponding adjustments to the trials,trial concepts and ruling ideas of government information publicity cases in light of the institutional environment shaped by the new regulations.Particular attention should be paid to issues such as adjudication reasons,legality standards,typed fast trials,dual administrative and judicial dispute resolution,plaintiff subject qualification,legal liability subject identification,scope of acceptance,active disclosure,review object,review focus,etc..
