摘 要:新《农村土地承包法》贯彻三权分置政策,重构了土地承包经营权的主体制度、权能体系和流转体系,并强化了该权利的稳定性。修正后的土地承包经营权的身份属性和保障功能得以固化,并在某种程度上具有了自物权或所有权的性质,成为家庭承包制下集体土地所有权实现的重要机制。随着与集体土地所有权的内在关联的提升,土地承包经营权在新法上晋级为物权性土地经营权的母权。适应土地承包经营权的功能转向和属性变化,正在制定的民法典物权编应当进行科学的回应,一方面巩固农村土地承包法的修法成果,另一方面弥补其修法之不足。Absrtact:The new Law of Rural Farmland-contracting implements the policy of separation of three rights,reconstructs the main body system,the power system and the circulation system of the right of operating of land-contracting,and strengthens the stability of the right.The identity and security functions of the operating right of land-contracting have been solidified,and to some extent,it has the nature of self-property right or ownership.It has become an important mechanism to realize collective land ownership under the household contracting system.With the promotion of the internal relationship with collective land ownership,the operating right of land-contracting has been promoted to the matriarchal or basic right of the real right to land operating in the new law.In order to adapt to the change of functions and attributes of the operating right of land-contracting,the real right edition of the Civil Code should respond scientifically.On the one hand,it should consolidate the achievements of the amendment of the Law of Rural Farmland-contracting,and on the other hand,it should make up for the deficiencies of the amendment.
