艺术品人工智能鉴定:法律主体定位及可行性探讨

摘　　要：当前艺术品鉴定的权威公正性随着艺术品作伪技术的升级、艺术品鉴定结论与鉴定收费之间的利益关联面临着严峻挑战,而人工智能鉴定技术的发展使得传统艺术品鉴定技术被攻破。由此衍生的法律主体定位问题使得人工智能在法律人格赋予、鉴定证书中的法律效力以及鉴定错误的责任承担上备受争议。基于人工智能于艺术品鉴定未来发展的重要意义,应从可行性角度限制性许可人工智能在艺术品鉴定上的法律人格,间接性认可人工智能在鉴定证书上的法律效力,以及适用严格责任原则区分相关责任者与人工智能的鉴定错误责任,确保艺术品人工智能鉴定朝着规范化、理性化方向发展。Nowadays the authority and impartiality of artworks authentication are facing severe challenges along with the upgrading forgery technology of artworks and the interest connection between artworks authentication conclusions and artworks authentication fees,but the traditional artworks authentication technology was broken by the development of artificial intelligence authentication technology.The problem about the status of legal subject derived from that makes artificial intelligence controversial in the area of endowment of legal personality,the legal effect of authentica tion certificate and the legal responsibility of authentication mistakes.Based on the significance of artificial intelli gence to the future development of artworks authentication,we should authorize the legal personality of artificial intelli gence restrictively in artworks authentication from the perspective of feasibility,indirectly recognize the legal effect of the authentication certificate by artificial intelligence,and determine the legal responsibility of relevant responsible person and artificial intelligence in authentication mistakes by applying strict liability principle,thus ensure that artifi cial intelligence authentication develops in the direction of standardization and rationalization.
