摘　　要：联合国气候变化马德里大会上关于《巴黎协定》市场机制实施细则的谈判各方依旧没有达成共识,这使得市场机制无法在2020年后的全球气候治理中更好地发挥作用。随着全球气候治理新形势的出现和"一带一路"的绿色发展,以中国碳交易市场为基础,先行构建公平合理的"一带一路"区域碳市场法律制度显得尤为必要,这也恰恰是全球生态文明建设的着力点、发力点和具体生动实践。京都期间已有欧美区域碳市场法律制度的不足,在后巴黎时代的新格局和新机遇下,立足我国国情,结合"一带一路"区域的实际,"一带一路"碳市场法律制度的构建应以生态文明理念为指引,保证各相关国家国内碳市场制度的相似性和兼容性。There is still no consensus among the negotiating parties at United Nations Climate Change Conference(COP 25)in Madrid on the implementation of the market mechanism in the Paris Agreement,which prevents the market mechanism from playing a better role in global climate governance after 2020.With the new situation of global climate governance and green development of"One Belt and One Road"initiative,to build a fair and reasonable"One Belt and One Road"regional carbon market legal system based on China's carbon trading market is exactly the acting point,starting point and concrete and vivid practice of global ecological civilization construction.By summing up the shortcomings of the legal system of carbon markets in Europe and the United States during the Kyoto Protocol period,under the new pattern and new opportunities of the Post-Paris era,based on China's national conditions and combining the reality of the"One Belt and One Road"area,we try to provide some feasible suggestions for the construction of the legal system of the"One Belt and One Road"regional carbon market.Empowered with the development of One Belt and One Road initiative,we hope the suggestions will help boost the building of the global ecological civilization.
