摘 要:我国金融扶贫工作呈现明显的政策化倾向和法律供给不足的特点,各地在开展金融扶贫工作时仍出现权力行使不规范、贫困人口权益受损等问题,亟需加强法律制约和保障。应当加强立法保障,为金融扶贫工作提供基本的法律依据;进一步建立金融扶贫对象精准识别和退出评估机制;建立金融扶贫多方主体协作机制,提升扶贫实效;在金融扶贫中建立有效的约束机制和激励机制,进一步规范权力的行使,提升金融扶贫效率。为提升政府金融扶贫决策法治化和科学化水平,完善一系列的金融扶贫配套制度,巩固脱贫攻坚成效,防止返贫,需在法治框架内推动金融扶贫工作,真正解决贫困地区贫困人口脱贫发展问题。At present,it is necessary to strengthen the legal restriction and guarantee for the problems such as the obvious policy-oriented tendency and the insufficient legal supply of the financial pro-poor work in the precision poverty alleviation in China.We should strengthen the legislative guarantee,provide the basic legal basis for the financial pro-poor work,further establish a mechanism for the accurate identification and withdrawal of the financial pro-poor objects,establish a multi-body coordination mechanism of the financial pro-poor,and improve the effectiveness of the pro-poor;The effective restraint mechanism and the incentive mechanism are set up in the finance pro-poor,and the exercise of power is further regulated and the efficiency of the financial poverty reduction is improved.To improve the government’s decision-making and scientific level of pro-poor decision-making,to perfect a series of financial pro-poor supporting systems,to consolidate the effectiveness of poverty alleviation and to prevent the return of poverty.In that framework of the rule of law,the problem of poverty alleviation in poverty-stricken areas is truly solved.
