摘 要:行政黑名单移除制度能够平衡信用评价权与信用修复权,通过信用激励措施降低政府监管成本,并通过行政黑名单的动态化管理实现信用重建。近年来,我国不断推进行政黑名单移除制度法治化,但该制度仍存在行政复核的相关程序不够完备、行政救济功能发挥不足、不良信用记录消除制度不周延、行政黑名单移除的信息公示不充分等问题。为重塑社会信用体系,应当建立行政复核的听证程序和中止程序,强化针对行政黑名单列入行为的行政救济,健全失信主体不良信用记录消除制度,提升行政黑名单移除的信息公示程度。The removal system of administrative blacklists can balance the power of credit evaluation and the rights of credit repair,reduce the cost of government supervision through credit incentives and realize credit reconstruction through the dynamic management of blacklists.In recent years,China has been promoting the legalization of the removal system of administrative blacklists,but there are still some problems in the system,such as the relevant procedures of administrative review are not complete,the function of administrative relief is not fully played,the system of eliminating bad credit records is not comprehensive,and the information publicity of removing administrative blacklist is not sufficient.To rebuild the social credit system,it is necessary to establish hearing procedures and suspension procedures of administrative review,strengthen administrative remedies for blacklisting behavior,improve the removal system of bad credit record of dishonest entities,and improve the information publicity degree of removing the administrative blacklist.
