摘 要:由于种种原因,不少承运人往往会选择投保本属于货主保险权益的货运险,一旦出险,保险公司却以对方不具有保险利益为由拒绝赔付,这样的结果对于投保人极其不利。为此,解决这一困境的破局之策就是从保险法的最大诚信原则入手,在认定承运人不具有保险利益的同时,令保险人承担缔约过失损害赔偿责任,以平衡投保人和保险人之间讯息不对称、专业水平不对等的现状,从而完善保险法实务中的纠纷解决方式。For some reason, many carriers often choose to cover cargo insurance which the consignors hold the insurance interest. Once the loss occurred, the insurance company rejects the benefit request based on the reason that the applicant has no insurance interest. This result is extremely unfavorable for the applicant. Therefore, the solution to this dilemma is to start from the Principle of the Utmost Good Faith in the insurance law. While determining that the carrier does not have an insurance interest, the insurer shall be liable for contractual negligence damages in order to balance the current situation of asymmetry of information and unequal professionalism between the policyholder and the insurer. Accordingly, it might improve the way of resolving disputes in insurance law practice.
