论治安传唤行为的法律属性及可诉性

摘　　要：当前,我国法律关于治安传唤行为法律属性的规定并不明确,在学界和实务界都存在分歧,争议主要集中在治安传唤行为是一种行政调查行为还是一种行政强制措施。治安传唤行为符合行政强制措施的法律特征而不符合行政调查的法律特征,所以,法律应当将治安传唤行为纳入行政强制措施的范围内;同时,由于治安传唤行为法律属性的不明确,实务中对于治安传唤是否具有可诉性也没有形成统一定论。因此,在将治安传唤行为认定为行政强制措施的基础上,将治安传唤分为中间环节的传唤和具有终局性影响的治安传唤。中间环节的传唤因为没有达到诉讼案件的成熟性标准,可以将其认定为辅助性的行政强制措施,而随着后续行为的被救济而得到救济。而对当事人具有终局性影响的治安传唤符合诉讼案件的成熟性标准,若将其认定为独立性的行政强制措施,当事人可以单独提起诉讼。这样,所有的治安传唤行为都能纳入到司法审查的范围内,从而能够保障当事人的基本权利。The legal nature of public security summons has not reached a consensus in the theoretical and practical circles.The main controversy is whether public security summons is an administrative investigation or an administrative coercive measure.This makes it impossible to determine whether the summons of public security is actionable in the theoretical and practical circles.The law and order summoning behavior does not conform to the legal characteristics of administrative investigation behaviors and the legal characteristics of administrative coercive measures.The law should include public security summons into administrative coercive measures that limit personal freedom.At the same time,according to the maturity principle,the public security summons in the middle link can be regarded as an auxiliary administrative coercive measure,which will be remedied as the follow-up actions are remedied.And the public security subpoena that has a final impact on the parties is determined as an independent administrative coercive measure,and the parties can file a lawsuit separately.In this way,all public security summons can be included in the scope of judicial review,thereby protecting the basic rights of the parties.
