关于妨害安全驾驶行为入罪问题的谦抑性分析

摘　　要：以危险方法危害公共安全罪对于评价和预防妨害公共交通工具安全驾驶行为没有充分发挥其应有约束力,原因在于司法实践中定罪和量刑标准难以确定,而非该罪本身对评价此类行为存在缺陷。基于刑法谦抑的角度考量,设立新罪不仅无必要,还会浪费立法和司法资源。应明确对该行为的定罪和量刑标准,从而减少“同案不同判”现象的发生。Parents are the most representative spokesmen for special children and the expression of education demand of special children from the perspective of parents is relatively more realistic.By using questionnaires to make a survey of the 102 parents of special children in Hangzhou,the results finds out that parents of special children have urgent demand for the various educations of school;in general,the presented characteristics of the demands of the special children’s parents are as following:(1)life is the center of the demand among special children’s parents;(2)focus on the collective lack of demand and neglect the individual different demand of special children;(3)strong desire for the demand of loss compensation.
