摘　　要：司法行为确定力是司法公信力的构成要素,其贯穿于管辖、审理、裁判、执行等整个司法程序。司法行为确定力以理性选择为价值基础,个体和群体的理性选择价值理念根植于司法行为确定力的形成和发展过程。司法管辖确定力是理性选择的历史形成;程序设计确定力是理性选择的制度安排;事实判断确定力立基于理性选择的价值理念;法律适用确定力是理性选择的最直接体现;裁判执行确定力是理性选择的最终结果。The determinacy of judicial action is an essential element of judicial credibility,which runs through the whole judicial process of jurisdiction,trial,adjudication and execution.The basis of judicial determinacy is rational choice whose value concept of individuals and groups deeply rooted in the formation and development of it.The determinacy of jurisdiction is the historical result of rational choice;The determinacy of programming is the institutional arrangement of rational choice;The determinacy of factual judgment is based on the value concept of rational choice;The determinacy of legal application is the most direct embodiment of rational choice;The determinacy of adjudication execution is the final result of rational choice.
