摘　　要：当下社区治理存在社区冲突持续不断和小区早衰等各种困境,充满挑战。为更清晰地理解利益冲突所导致的困境,基于国家与社会关系的视角,通过探讨“国家?社会”关系的制度、哲学及话语三种传统建构以及个人与国家间的联系机制,可呈现出国家与社会间互相建构的关系,进而构建出国家与社会关系的公共生活转向,并发现社区、小区中存在的关系性、政治性及利益性三种公共生活。从国家与社会互构关系的角度看,多发的利益冲突理应引发相应的转型:社会冲突之所以持续是因为社区和小区中利益性公共生活的缺失,同样也是因为国家和社会制度的不健全、矛盾无法转移使得利益冲突各方持续对抗。为解决这样的困境,在建立能使利益性公共生活正常运行机制的同时,亦应随之构建出契合的配套制度,以实现社会良好运转和国家繁荣昌盛。Community governance is facing challenges like lasting conflicts as well as early aging.How to understand these difficulties needs viewpoints based on the relationship between state and society,and there are three traditional ways:institutional,philosophical and discourse approaches.We identify the mutual construct relationship between state-society,and take public life as mechanism to deconstruct challenges in communities.We identified three interact mechanism in community:guanxi type,political type and privateinterest type.From the view of mutual construct,the lasting of conflicts not only caused by the lacking of mechanism for private-interests involved public life,but also by the unwell-functioning mechanism between state and social system.We suggest create supporting systems for a stable society and prosperous state.
