论民法典婚姻家庭编对婚约之取舍

摘　　要：在民法典婚姻家庭编历经三审,于2020年即将通过之际,三次审议的草案稿都没有发现婚约的内容。台湾地区民法典对婚约作出了详细的规定,从订约的年龄,解约的情形到损害的赔偿,将西周伊始的婚约习俗纳入到民法的体系,通过法律手段调整婚约关系。作为有相同历史传统、婚约习俗的大陆地区而言,婚约在婚姻关系的缔结中同样是必要的程序,同时涉及到较大数额的财产往来,对双方的家庭都会造成重大的影响。民法典作为社会生活的权利保障书,对于婚约习俗是否需要作出回应,会影响到每个社会成员的利益。是否可以借鉴台湾地区民法典的婚约立法内容,制定出具有中国特色的婚约立法,值得作出探讨。In the Civil Code,the marriage and family were edited through the third trial.At the beginning of the next year,there is no contents of the marriage contract in the draft of the three deliberations.The Taiwan Civil Code has detailed provisions on the marriage contract.From the age of contracting,the situation of contract cancellation to the compensation for damage,the marriage convention at the beginning of the Western Zhou Dynasty is incorporated into the civil law system,and the marriage contract relationship is adjusted through legal means.As a mainland region with the same historical traditions and marriage conventions,the marriage contract is also a necessary procedure in the conclusion of the marriage relationship.At the same time,it involves a large amount of property transactions,which will have a major impact on the families of both parties.As a guarantee of the right to social life,the Civil Code needs to respond to the custom of marriage and marriage,which will affect the interests of each member of society.Whether it is possible to draw on the content of the marriage contract legislation of the Taiwan Civil Code and to formulate the marriage contract legislation with Chinese characteristics is worth exploring.
