编纂民法典婚姻家庭编的法理思考与立法建议

摘　　要：编纂民法典婚姻家庭编的基本立法思路是,高度重视亿万人民群众对婚姻家庭和谐幸福的根本利益需求,高度重视婚姻家庭关系的人伦本质和人文关怀,高度重视社会主义核心价值的融会贯通,坚持大民法的理念,弘扬当代中国社会主义民法的法理思想,实现民法的立法目的。民法典婚姻家庭编应秉持的法理思想包括人权平等、人格尊严、人身自由、人亲和谐、人际诚信、人性友善、人财共济、人伦正义、人本秩序、人文关怀,这些法理思想又体现在由核心法理、基本法理、具体法理和法律规范构成的严密的逻辑结构之中。在完善民法典婚姻家庭编时,应当严格遵循其基本立法思路,在其基本法理思想的指导下,修改或增设若干一般规定或具体章节,唯有如此,才能精益求精,满足广大人民群众对它的美好期待。The basic legislative thinking of compiling the marriage and family part of the Civil Code is to attach great importance to the fundamental interests of millions of people who are looking forward to the harmonious and happy marriage and family, to attach great importance to the human nature and humanistic care of the marriage and family relations, to attach great importance to the integration of the core values of socialism, to adhere to the concept of the great civil law, to carry forward the Fali idea of the contemporary socialist civil law of China, and to realize the legislative purpose of civil law. The Fali ideas that should be upheld in the marriage and family part of the Civil Code include equality of human rights, human dignity, personal freedom, harmony of kinship, interpersonal integrity, human friendliness, mutual help and property sharing, justice of human relations, human-oriented order, and human concern. These Fali ideas are also reflected in the strict logical structure composed of core Fali, basic Fali, specific Fali and legal norms. In order to improve the marriage and family part of the Civil Code, we should strictly follow its basic legislative ideas, and add some basic institutions including general provisions and specific chapters under the guidance of its basic Fali ideas. Only in this way can we strive for perfection and meet the people’s good expectations for it.
