摘 要:退休再就业作为非典型的用工形式,其工伤损害赔偿往往面临困境。概括而言,主要障碍在于退休再就业法律关系的定性和《工伤保险条例》的适用。本文回归最基本的规范分析方法 ,尝试通过横向和纵向的立法梳理,探求立法的本意并进行评价分析,提出退休再就业人员工伤损害赔偿困境的根源在于立法对退休再就业人员劳动者身份的模糊处理和工伤认定实体、程序上的缺陷,并试图通过重构退休年龄的制度功能、扩大工伤保险适用范围、与商业保险的互补适用等路径选择寻找化解上述困境之出路,并对企业雇用退休再就业人员法律风险防控提出建议。As an atypical form of employment, reemployment after retirement is often faced with difficulties in compensation for work-related injury.To sum up, the main obstacle lies in the qualitative nature of legal relation of emeritus reemployment and "regulation of inductrial injury insurance" applicable.Return to the most basic method of normative analysis, this paper attempts to comb through legislation by horizontal and vertical, to explore the intention of legislation and evaluation analysis, proposed retirement again obtain employment personnel injury damages dilemma is rooted in the legislative workers to retire again obtain employment personnel fuzzy processing and industrial injury of the identity of the entity and procedural defects, and attempts to reconstruct the retirement age system functions and expand the scope of application of inductrial injury insurance, path selection for resolving way out of the predicament, and for companies to hire retired re-employment personnel legal risk prevention and control are proposed.
