论自治法规变通条款司法适用中的法律冲突与应对思路——基于与经济特区法规的比较

摘　　要：在我国民族自治地方和经济特区均有立法变通权,可分别制定自治法规和经济特区法规。尽管经济特区法规在数量上远不及自治法规,但裁判文书网检索的结果显示,法院对于经济特区法规中的变通条款适用却更为频繁。尽管从制度层面看自治法规在民事、行政、刑事案件审理均有适用的空间,只是适用的方式不同,然而立法法所确立变通规定在民族自治地方优先适用的原则在司法实践中仍然难以发挥实效。主要原因还在于实务部门认知上偏差,对此首先应提升对民族区域自治制度的认知,厘清单行条例的独特属性,最后对变通条款的正当性存疑的再报请有权机关处理。Both ethnic autonomous areas and special economic zones(SEZ)have the right of legislative adaption in China,with which autonomous regulation and SEZ regulations can be formulated correspondingly.Although the number of SEZ regulations is far less than that of autonomous regulations,the search result of China Judgments Online shows that the adaptive provisions in SEZ regulations are more frequently adopted by the courts.There is room in the institutional level,though only in different ways,for the autonomous regulations to be applied in civil,administrative and criminal cases,but the principle established in the legislation law,namely the preferential application of adaptive provisions in ethnic autonomous areas,still plays a very limited role in judicial practice.The main reason lies in the cognitive deviation of some judiciary authorities,so we should first improve our cognition of the regional ethnic autonomy,clarify the unique attributes of the special regulations,and finally report to the competent authorities for handling the questionable appropriateness of the adaptive provisions.
