摘　　要：为研究非关税贸易壁垒下食(药)用菌进出口贸易的法律风险控制,基于非关税贸易壁垒以及食(药)用菌基本定义,分析非关税贸易壁垒对我国食(药)用菌出口量、提高出口企业成本、降低竞争优势、降低国民收入的影响,并基于影响内容从外贸合同条款方面提出控制"风险条款"、控制"支付条款"风险、控制"质量条款"风险、确定争议解决条款、避免"格式合同"等五条法律风险控制方法,为降低非关税贸易壁垒下食(药)用菌由进出口贸易造成的法律风险提供依据。With the development of edible drug bacteria,edible drug bacteria import and export trade has become the main part of China’s import and export trade.Study of non-tariff barriers to trade import and export trade of edible antibacterial legal risk control,based on the basic definition of non-tariff barriers to trade and consumption of antibacterial analysis of non-tariff trade barriers on China’s consumption of antibacterial with exports of non-tariff trade barriers to China’s consumption of antibacterial,improve our export enterprise cost,to reduce the competitive advantage,reduce the effect of national income in our country,Based on the above affect the content control is put forward from the aspects of foreign trade contract terms risk clause,payment terms control risk,control risk quality clause,determine the dispute resolution clause,to avoid format contract five non-tariff barriers to trade import and export trade of edible antibacterial legal risk control method,in order to reduce non-tariff trade barriers under the consumption of antibacterial provides the basis for the legal risks caused by the import and export trade.
