摘 要:行政诉讼第三人制度是行政诉讼中的一项重要制度,也是一项极具理论价值和实践意义的课题。然而由于我国行政诉讼起步较晚,在诸多方面都不够完善,行政诉讼第三人制度也存在着立法内容简单、司法实践指导性较差等问题,在第三人的资格认定以及权利救济等多方面存在着一定的疏漏。在合理界定行政诉讼第三人时,关键是要考虑第三人参与的诉讼时间、利害关系的范围等因素。第三人的界定包括范围界定、时间界定、权限和地位界定,通过制度完善合理界定第三人,有利于为保障行政诉讼第三人合法利益奠定基础。The third party system of administrative litigation is an important system in administrative litigation,and also a subject of great theoretical value and practical significance.However,due to the late start of administrative litigation in China,it is not perfect in many aspects.The third party system of administrative litigation also has some problems such as simple legislative content,poor judicial practice guidance,and some omissions in the third party qualification and right relief.When reasonably defining the third party in administrative litigation,the key is to consider the factors such as the time of the third party’s participation in the litigation,the scope of interests and so on.The definition of the third party includes the definition of scope,time,authority and status.The rational definition of the third party through the improvement of the system is conducive to laying the foundation for the protection of the legitimate interests of the third party in administrative litigation.
