新刑诉法背景下人民监督员制度的发展

摘　　要：人民监督员制度是人民检察院在能否有效地打击职务犯罪的质疑中产生的,虽然人民检察院如今已基本不再行使自侦权力,但新修订的《检察院组织法》明确规定了人民监督员制度,因此,人民监督员制度仍有存在的必要,然而需要对其进行改革。人民监督员的监督范围应当确定为人民检察院针对所有案件的不起诉决定。为了保障人民监督员的人民性,人民监督员应当从有选举权的公民中随机抽选产生。最后,有必要赋予人民监督员监督的强制效力。The system of people’s supervisor is produced in the doubt of whether the people’s procuratorate can effectively crack down on the crime of duty. Although the people’s procuratorate no longer basically exercises the power of investigating the crime of duty,the newly revised Organic Law of the People’s Republic of China on the People’s Procuratorates clearly stipulates the system of people’s supervisor. Therefore,the system of people’s supervisor is still necessary,but it needs to be reformed. The scope of supervision of the people’s supervisors shall be the decisions of non-prosecution for all cases from the people’s procuratorate. In order to ensure the people’s character of the people’s supervisors,they should be randomly selected from the citizens with the right to vote. Finally,it is necessary to give the people’s supervisors the compulsory effect of supervision.
