摘  要:网络直播打赏涉及直播平台、打赏人和主播三类主体,各主体与其他主体之间存在不同的法律关系。具体而言,平台与主播之间存在附条件的买卖合同关系,打赏人与主播、平台与打赏人之间均存在服务合同关系。网络直播打赏主体不同且打赏形式多样,可能引发诸多法律问题。日常生活中出现的未成年人打赏、夫妻一方使用夫妻共同财产打赏、用户因对主播外貌存在认识偏差而打赏的情况不在少数。不同情形下打赏行为的法律性质存在差异,由此引发的法律纠纷也应视不同情形分别处理,并采用不同的法律规制路径加以解决。Webcast rewards involves three types of subjects:live broadcasting platform,rewarder and anchor.Different legal relationships exist between the subjects and other subjects.Specifically,the platform and the anchor have a conditional sales contract relationship,and the rewarder and the anchor and the platform and the rewarder have a service contract relationship.Thanks to the difference of the subjects of webcast and the diversity of the forms of rewards,many legal problems may arise.In daily life,minors may pay rewards for webcast,one spouse may use the couple's community property for the reward,users may reward anchors for perceived biases in their appearance,and so on.These are not rare.There are differences in the legal nature of reward behavior under different circumstances,so the legal disputes caused by this should be handled according to different circumstances,and different legal regulation paths should be adopted to solve them.
