摘　　要：本研究以基因专利申请为视角,从基因专利一般理论的基础上对基因专利申请与审核中存在的不同问题进行分析研究,并有针对性地就违反单一性原则、权利要求扩张、实用性审查宽松、公开期间保护弱等问题提出建议,以期为完善我国专利法作出理论支持。From the perspective of gene patent application,based on the general theory of gene patent,this study analyzes and studies the different problems existing in gene patent application and examination,and puts forward suggestions on the violation of the principle of oneness,the expansion of claims,the loose examination of practicability,and the weak protection during the period of publication,with a view to providing theoretical support for the improvement of China’s patent law.
