天然林保护立法的基本原则、价值取向和制度设计重点

摘　　要：以推动天然林保护立法为目的,采取政策解读、法律分析与实证研究相结合的研究方法,得出以下结果:1)天然林保护立法在价值取向上应当彰显国家生态安全和经济社会可持续发展价值;2)天然林保护立法在基本原则上应当坚持全面保护与突出重点、尊重自然与科学修复、生态为民与保障民生、政府主导与社会参与相结合;3)天然林保护立法的制度设计重点在于:明确天然林的范围,并实现与公益林并轨管理;夯实各级政府责任;制定天然林保护专项规划和实施方案;明确天然林保护修复具体措施;确定天然林保护重点区域及其管理措施等。研究结论认为,我国单独制定《天然林保护条例》符合《天然林保护修复制度方案》的政策要求以及《森林法》的授权规定,但可能会增添《森林法实施条例》的修改难度,需要统筹考虑。The purpose of this study is to promote the legislation of natural forest protection,and the research methods of policy interpretation,legal analysis and empirical research are adopted.The results are as follows:1)the value orientation of natural forest protection legislation should highlight the value of national ecological security and sustainable economic and social development;2)the basic principles of natural forest protection legislation should adhere to comprehensive protection and highlight the key points,respect for nature and scientific restoration,ecology for the people and guarantee the people’s livelihood,government guidance and social participation;3)the system design of natural forest protection legislation focuses on:clear the scope of natural forest,and achieve the integration of management with public welfare forest;strengthen the responsibilities of governments at all levels;formulate special plans and implementation plans for natural forest protection;define specific measures for natural forest protection and restoration;determine Key areas of natural forest protection and management measures.The conclusion of the study is that China’s independent formulation of the regulations on natural forest protection and restoration conforms to the policy requirements of the scheme of natural forest protection and restoration system and the authorization provisions of the forest law,but it may increase the difficulty of the revision of the regulations on the implementation of the forest law,which needs to be considered as a whole.
