摘　　要：通过总结一起土地出让行政案件的关键争议焦点,分析和考察土地管理部门在土地出让程序中是否负有对出让土地进行地质勘察,以及告知出让地块的地质状况和地质条件的义务,总结土地出让法律和实践中应当公告"土地现状"的正确内涵。在厘清土地出让实践以及司法实务中对"土地现状"的认识,批驳对"土地现状"含义的错误理解和适用的基础上,提出由本案而产生的几点思考。Through summarizing the crucial controversial issues of an administrative case of land transfer,the paper analyzes and supervises whether the land management department has the obligation to implement the geological survey on the transferred land during the process of land transfer,as well as to inform the geological status and geological conditions of the transferred land,and then summarizes the correct connotation of "land status" that should be announced in the law and practice of land transfer.On the basis of clarifying the understanding of "land status" in the practice of land transfer and judicial practice,and refuting the wrong understanding and application of the meaning of "land status",the paper puts forward some thoughts inspired by this case.
