摘　　要：涉网络不正当竞争纠纷是知识产权民事案件中与技术、市场发展结合较为密切的一类案件,此类案件的裁判在新科学技术的合理运用、新商业模式的合法拓展,以及新市场行为的边界划定等方面均发挥了重要作用,进而系司法推动营商环境优化的关键环节。本文立足辖区的区域特点,以海淀法院近三年涉网络不正当竞争纠纷为研究样本,并根据营商环境对司法保护的要求,梳理和分析此类案件的整体情况及发展趋势,并结合典型案例对程序和实体两个层面的若干法律适用难点问题进行归纳和分析,进而提出知识产权司法保护应当关注的工作重点,以及优化营商环境既需要司法机关发挥和延伸审判职能,更需要企业、行业以及行政机关等多方主体的合作与协同等建议。Internet unfair competition disputes are a type of intellectual property civil cases that are closely integrated with technology and market development.The judgment of such cases has played an important role as in regards to the appropriate use of new technologies,the development of new legitimate business models,as well as defining the new guidance for market methodology,which is a key link in judicial promotion of the business environment.Based on the characteristics of jurisdiction and the intellectual property trial practice of Beijing Haidian District People’s Court in the past three years,this article summarizes and analyzes the overall situation and development trends of unfair competition cases involving the Internet.With a view to proposing work priorities in judicial protection of intellectual property,it will analyze several difficulties in the application of certain laws from typical cases at both the procedural and substantive levels.Finally,it is suggested that optimizing the business environment not only requires the judicial authorities extend trial functions,but also requires the cooperation and synergy of multiple parties such as enterprises,industries and administrative agencies.
