老年人诉讼代理制度建构的必要性、理论基础及路径

摘　　要：当前,我国60周岁以上老年人不足以在诉讼中自我保护。我国《民法通则》针对无民事行为能力人和限制民事行为能力人规定的监护制度在诉讼中很难充分地保护涉诉老年人的合法权益。现有的法律援助制度由于缺乏针对老年人合法权益予以保障的专门条款,加之其援助任务繁重,对老年人合法权益的保护亦难尽如人意。基于目前的社会现实和法制发展现状,我国亟须建构老年人诉讼代理制度,以更好地保护涉诉老年人的合法权益。At present,the aged over 60 years old cannot protect themselves enough in the lawsuit.The guardianship system stipulated in General Principles of the Civil Law for people with no civil capacity and limited civil capacity is difficult to fully protect the legal rights and interests of the elderly involved in the lawsuit.The existing legal aid system is not sastisfying to protect the legal rights and interests of the elderly due to lack of special provisions to protect the legal rights and interests of the elderly as well as the heavy task of assistance.Based on the current social reality and the development of the legal system,it is urgent for China to establish a litigation agency system for the elderly in order to better protect the legal rights and interests of the elderly involved in litigation.
